Terms of Service

1. Introduction

Welcome to GolfStat ("we", "us", "our"). These Terms of Service ("Terms") govern your use of the GolfStat web application and all related services (collectively, the "Service"). By creating an account and using GolfStat, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Service. If you have any questions, please contact us at golf_stat@yahoo.com.

2. Subscription & Billing

• Subscription plan: GolfStat is available on an annual subscription basis at the price displayed on the app. The subscription period is 12 months from the date of activation.
• Auto-renewal: Your subscription will automatically renew at the end of each annual period for a further 12 months, at the same price unless otherwise notified. The renewal fee will be charged to the payment method you originally used.
• Cancellation: You may cancel your subscription at any time via the Settings page. Cancellation prevents the subscription from renewing at the end of the current period. You will continue to have full access to all features until the end of your current subscription period.
• Non-refundable: All subscription fees are non-refundable. Once a payment has been processed, it will not be refunded, credited, or pro-rated — even if you cancel partway through the subscription period. If you cancel, access continues until the expiry date of the current period, and no further charges will be made.
• Payment processing: All payments are processed securely by Stripe. We do not store or have access to your card details at any time.
• Price changes: We reserve the right to change the subscription price for future renewal periods. Any price change will be communicated in advance, and the new price will only apply to the next renewal cycle. Existing subscriptions will not be affected until renewal.

3. Free Trial

• Trial duration: New users are eligible for a 14-day free trial of GolfStat, beginning on the date the trial is activated. The trial provides full, unrestricted access to every feature of the Service for the duration of the trial period.
• No card required: No payment details are required to start a trial. You will not be charged during or at the end of the trial period unless you actively choose to subscribe.
• What happens when the trial ends: At the end of the 14-day trial period, your access will automatically convert to view-only mode. You will be able to view all of your previously recorded rounds, statistics, and practice history, but you will not be able to add new rounds, log practice sessions, or use features that require an active subscription. Your data will be preserved and is not deleted.
• Subscribing: You can subscribe to a full annual subscription at any time during or after the trial via the Settings page. If you subscribe during the trial, your paid subscription will begin immediately and the remaining trial period will end.
• One trial per user: The free trial is limited to one trial per user. Creating multiple accounts or otherwise attempting to obtain more than one trial is a breach of these Terms. Users who have previously used a trial — including former subscribers whose subscription has since expired — are not eligible to start a further trial.
• Eligibility: We reserve the right to determine trial eligibility, to refuse a trial at our discretion, and to modify, suspend, or discontinue the free trial offer at any time without notice. Any such change will not affect trials that have already been activated.
• Trial abuse: We reserve the right to terminate any trial immediately and without notice where we reasonably believe it is being misused, including attempts to extend the trial, circumvent the one-trial limit, or access the Service through multiple accounts.

4. Your Account

• You must provide accurate and complete information when creating your account.
• You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
• You must be at least 18 years old, or have the consent of a parent or guardian, to create an account and subscribe.
• You agree to notify us immediately if you become aware of any unauthorised use of your account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Share, sell, or otherwise transfer your account or subscription to another person.
• Attempt to reverse engineer, decompile, or disassemble any part of the app.
• Use automated tools, bots, or scrapers to extract data from the Service.
• Upload or transmit any malicious code, viruses, or harmful content.
• Interfere with or disrupt the servers, networks, or functionality of the Service.

6. The Service

• "As-is" basis: GolfStat is provided on an "as-is" and "as-available" basis. While we strive to provide a reliable and accurate service, we do not guarantee that the app will be uninterrupted, error-free, or available at all times.
• AI recommendations: Any coaching notes, practice recommendations, or performance insights generated by the AI Coach are for guidance and informational purposes only. They do not constitute professional coaching advice and do not guarantee any improvement in performance. Always use your own judgement.
• Handicap tracking: The handicap index calculated within GolfStat is a personal tracking tool only. It is not an official handicap and has no affiliation with any recognised handicapping body (such as the WHS, CONGU, or USGA).
• Third-party links: The app may contain links to third-party services (e.g. lesson booking, podcasts). We are not responsible for the content, policies, or practices of those third parties.

7. Intellectual Property

All content, features, branding, design, and functionality of GolfStat — including but not limited to the logo, text, graphics, software, proprietary algorithms, and statistical models — are the intellectual property of GolfStat and are protected by applicable copyright and trademark laws.

Your golf performance data remains your own. We do not claim ownership of the data you input. However, you grant us a licence to process and display that data within the app for the purpose of providing the Service to you.

8. Limitation of Liability

• To the fullest extent permitted by law, GolfStat shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
• We are not liable for any loss of data resulting from system failures, server outages, or circumstances beyond our reasonable control.
• Our total liability for any claim arising from the use of the Service shall not exceed the subscription fee you have paid in the 12 months preceding the claim.
• You use the Service and any AI-generated recommendations at your own risk.

9. Termination

You may stop using GolfStat and cancel your subscription at any time via the Settings page.

We reserve the right to suspend or terminate your account if you breach these Terms, engage in abusive or unlawful behaviour, or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Any subscription fees already paid are non-refundable.

10. Changes to These Terms

We may update these Terms of Service from time to time. Any changes will be published within the app with an updated date at the top of this page. Continued use of GolfStat following an update constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
